1.Introduction
These Terms of Use (hereinafter referred to as "the Terms") set forth the conditions for using the services operated by Liviro Inc. (hereinafter referred to as "the Company"): "Tattoo Japan" (tattoo-ja.com, hereinafter referred to as "the Portal") and "Tattoo Japan Studio" (studio.tattoo-ja.com) (collectively referred to as "the Service"). Users shall use the Service upon agreeing to these Terms.
2.Service Description
The Service consists of the following two services: (1) Tattoo Japan (Portal): An information-sharing platform that allows users to register, search, and edit information about tattoo studios and tattoo-friendly facilities in Japan, post reviews, and share tattoo design images. (2) Tattoo Japan Studio (SaaS): A cloud-based business management service for tattoo studios and artists, providing features such as customer management, appointment scheduling, design management, client records, and consent form management.
3.Use of External Services
The Service uses external services including Google Login, email login, Google Analytics (GA), Google Tag Manager (GTM), Google AdSense, A8.net affiliate links, Stripe for payment processing, and Supabase for database services. Data obtained through these external services may be used for service provision, improvement, and advertisement delivery. The terms and privacy policies of each respective external service shall additionally apply to their use.
4.User Responsibilities
Users shall ensure that the information they register or edit is truthful and accurate. Posting false or inappropriate information is prohibited. On the Portal, information registered by users may be edited by the operator or other users. For Tattoo Japan Studio, users who register customer information or other third-party personal data are responsible for obtaining necessary consent from such third parties and shall comply with the Act on the Protection of Personal Information and other applicable laws.
5.Prohibition of Scraping and Similar Acts
Unauthorized crawling, scraping, or other mechanical methods to obtain or reproduce the content posted on the Service are prohibited. Legal actions may be taken in the event of violations.
6.Correction Requests from Facility Owners
If there are any errors in the facility information on the Portal, facility owners may request corrections or deletions by contacting the Service. The operator will respond appropriately after verification.
7.Rights to Posted Content
Copyrights of texts, images, and other content posted by users belong to the users in principle. However, the Service may use the content free of charge and non-exclusively for operation, publicity, and improvement purposes.
8.Prohibited Activities
Users shall not engage in the following activities: (1) Acts that violate laws or public order and morals. (2) Acts related to criminal activity. (3) Acts that interfere with the servers or network functions of the Service. (4) Acts that may disrupt the operation of the Service. (5) Unauthorized collection or accumulation of personal information of other users or third parties. (6) Unauthorized access or attempts thereof. (7) Impersonation of other users. (8) Reverse compiling, reverse engineering, disassembling, or similar acts on the Service's software. (9) Using data obtained from the Service to develop competing services. (10) Any other acts deemed inappropriate by the Company.
9.Disclaimer
The Service does not guarantee the accuracy, completeness, or usefulness of any posted information. Users shall use the Service at their own responsibility, and the Company shall not be liable for any damages resulting from the use of the Service. Regarding Tattoo Japan Studio, the Company makes no warranties, whether express or implied, regarding system uptime, data integrity, or fitness for a particular purpose.
10.Service Changes, Suspension, and Termination
The Company may change the content of the Service, or suspend or terminate the Service without prior notice to users. However, for paid Tattoo Japan Studio plans, the Company shall endeavor to provide a reasonable advance notice period prior to service termination. The Company shall not be liable for any damages caused to users by such changes, suspension, or termination.
11.Account Management and Responsibility
Users are responsible for appropriately managing their account information. The Company shall not be liable for unauthorized use by third parties. Tattoo Japan Studio users, given the nature of handling customer personal information, are particularly obligated to maintain a higher standard of security management, including password management and the prohibition of disclosing login credentials to third parties.
12.Suspension or Deletion of Account
If a user violates these Terms, the Company may suspend or delete the user's account without prior notice. Upon account deletion, data associated with the account (including customer data stored in Tattoo Japan Studio) will be deleted within a reasonable period, except where retention is required by law.
13.Handling of External Links
The Service may contain links to other websites. The Company is not responsible for the content of linked websites.
14.Site Supporter and Paid Membership
The Portal offers a Site Supporter feature that allows users to voluntarily support the service. Payments are processed through external services such as Stripe. Site Supporter payments are used for operational and development costs and are non-refundable. Additionally, the Portal plans to offer paid membership plans in the future. When paid membership plans become available, details including membership benefits, pricing, duration, cancellation, and refund policies will be provided separately, and users shall agree to the terms before subscribing.
15.Tattoo Japan Studio Subscription
Tattoo Japan Studio is provided through the following subscription plans: Individual Plan at 9,800 JPY per month (tax included); Studio Plan at pricing available upon inquiry; Additional Artists at 1,980 JPY per person per month (tax included). Each plan includes a 2-month free trial period during which cancellation is available at any time with no charges. After the trial period ends, the plan automatically converts to a paid subscription and billing commences using the registered payment method. Detailed pricing, plan features, and cancellation procedures are separately specified on the Tattoo Japan Studio registration page. The Company may modify subscription fees, plan details, free trial periods, and other terms of service due to changes in service content, economic conditions, or other circumstances. In the event of a fee increase or other changes materially disadvantageous to users, the Company shall provide notice at least 30 days prior to the effective date of the change through reasonable means such as posting on the Service or email notification. Continued use of the Service after the effective date of the change shall constitute acceptance of the modified terms. Users who do not agree to the changes may cancel their subscription before the effective date of the change.
16.Data Handling in Tattoo Japan Studio
Ownership of business data registered by users in Tattoo Japan Studio (customer information, appointment data, design data, client records, consent forms, etc.) belongs to the user who registered such data. The Company accesses this data only to the extent necessary for service provision, operation, and improvement. Users may request the Company to export their registered data during their active account period. Data will be retained for 90 days after cancellation and then permanently deleted.
17.Intellectual Property Rights
Copyrights, trademarks, and other intellectual property rights related to the Service belong to the Company or their rightful owners. Users are not granted any license to such intellectual property rights through the use of the Service. However, content created and posted by users themselves shall be governed by the provisions of Section 7.
18.Limitation of Liability
Even in cases where the Company is liable for damages to a user, the Company's liability shall be limited to the total amount of fees paid by the user to the Service during the preceding 12-month period. This limitation shall not apply to damages caused by the Company's willful misconduct or gross negligence.
19.Amendments to the Terms
The Company may revise these Terms as necessary in accordance with Article 548-4 of the Japanese Civil Code. The Company may amend the Terms when the amendment is in the general interest of users, or when the amendment does not conflict with the purpose of the contract and is reasonable in light of the necessity for the amendment, the appropriateness of the amended content, and other circumstances. When amending the Terms, the Company shall communicate the content and effective date of the amended Terms to users through reasonable means such as posting on the Service or email notification prior to the effective date. For material changes disadvantageous to users, including fee increases, the Company shall provide notice at least 30 days prior to the effective date. Continued use of the Service after the effective date shall constitute acceptance of the amended Terms.
20.Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising from the Service shall be subject to the exclusive jurisdiction of the Osaka District Court as the court of first instance.
